Terms of Service

By activating your store on PosArch, you agree to these operational rules, subscription billing mandates, and legal terms. Last updated: July 1, 2026.

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between PosArch ("we," "our," "us") and you ("User," "Merchant," "you"), covering your access to and use of our POS retail software operating systems, database hosting, API components, and AI demand forecasting networks. By creating an account or clicking subscribe, you accept and agree to be bound by these terms.

2. User Responsibilities

You are responsible for obtaining and maintaining the hardware, power, internet networks, barcode scanner items, and receipt printers needed to operate PosArch. You must ensure your cashiers staff is instructed on proper system usage and complies with these Terms. You assume full legal responsibility for any stock quantities, price entries, categorizations, and receipt items handled under your profile.

3. Account Registration

To register a store profile, you must provide valid, accurate, and current business credentials (including name, email address, phone number, and category). You are responsible for keeping your login credentials confidential and are fully liable for all activities that occur under your store account. You must notify us immediately of any unauthorized access.

4. Subscription & Billing

PosArch is offered on a subscription model (monthly or yearly cycles). Subscriptions automatically renew at the end of each billing interval unless cancelled. Payment processing is handled by third-party checkout gateways (such as Razorpay). We reserve the right to modify pricing terms, with prior notice.

5. Software License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the PosArch POS system. You may not resell, lease, distribute, or modify the source code, stylesheets, database models, or visual components without our explicit written permission.

6. Acceptable Use

You agree to use PosArch only for legitimate retail, catalog inventory, sales, and billing management. You may not exploit the system to record prohibited items, evade taxes, upload malware, bypass security layers, or execute high-volume automated scripts that degrade server database speeds.

7. Intellectual Property

All rights, title, and interest in and to PosArch (including AI forecasting algorithms, UI designs, code modules, databases structures, logos, trademarks, and copyright assets) are and will remain our exclusive property. Your subscription grants you a right of usage, not ownership.

8. Limitation of Liability

To the maximum extent permitted by law, PosArch is provided "as is" and "as available". We make no warranties, express or implied. We shall not be liable for any direct, indirect, incidental, or consequential damages resulting from database downtime, hardware mismatch failures, transaction inaccuracies, or loss of store logs.

9. Termination

We reserve the right to suspend or terminate your account at any time at our sole discretion, without liability, if you breach these terms or fail to pay subscription fees.

Suspension Trigger warning: Misuse, engagement in illegal activities, reverse engineering the POS source code, or attempting unauthorized database access will result in the immediate and permanent suspension of your active account, with no eligibility for refund options.

10. Changes to Terms

We reserve the right to alter these Terms of Service. If we execute substantial modifications, we will notify you by updating these terms, sending newsletters, or posting banner updates inside the billing terminal. Continued usage of PosArch after updates indicates full acceptance of the revised Terms.

11. Governing Law (India)

These Terms of Service and any contractual disputes arising from them are governed by and construed in accordance with the laws of India. All legal claims must be filed exclusively under the jurisdiction of competent courts in India.
